FAQ

VCAT Expert Witness Reports in Tarneit: common questions

Do I have to go to the Building and Plumbing Commission before VCAT?

In most cases, yes. A party cannot apply to VCAT about a domestic building work dispute without a certificate of conciliation from the Building and Plumbing Commission's dispute resolution service (formerly DBDRV), showing the dispute was not suitable for conciliation or was not resolved. Applications for an injunction are the exception. Before applying to the service, put the defects to your builder in writing.

Can the report be used at conciliation as well as at VCAT?

Yes. A report that lists each defect, the standard it fails and the fix gives the conciliation officer and the builder something specific to answer. The service can also arrange its own assessor to inspect the work. If the dispute goes on to VCAT, its building disputes practice note says any available expert report on defective or incomplete work should accompany the application.

Whose side is the expert on?

The tribunal's. PNVCAT2 says an expert witness has a paramount duty to VCAT, not to the party paying for the report, and is not an advocate. So the report records the items that are acceptable as well as those that are not.

What has to be in a VCAT expert witness report?

The practice note sets the contents: the expert's qualifications and experience, all instructions received, the facts and assumptions relied on, the documents reviewed, a summary of opinions, anything outside the expert's field and a signed declaration. Where rectification is recommended, the report must give the reasons, the likely cost and whether a reasonable alternative exists. Each item then carries photographs, measurements and the clause it fails.

What is the builder's work measured against?

First the contract, plans and specifications, because section 8 of the Domestic Building Contracts Act 1995 implies warranties that the work follows them, complies with the law including the Building Act 1993, and is done with reasonable care and skill. Then the National Construction Code and Australian Standards such as AS 2870 for slabs, AS 3740 for wet areas and AS 1684 for timber framing. Finishes and tolerances are judged against the Guide to Standards and Tolerances.

Which edition of the Guide to Standards and Tolerances applies to my home?

It depends on the contract date. The 2026 Guide applies to contracts entered into or work started from 1 August 2026, so a home built under a contract signed before that date is assessed against the 2015 Guide. The Guide is advisory, and where the contract, the law, the NCC or a standard says something different, that takes precedence.

Is there a time limit on a claim against the builder?

Yes. Under section 134 of the Building Act 1993, a building action cannot be brought more than 10 years after the occupancy permit was issued, or after the certificate of final inspection if there was no occupancy permit. The section 8 warranties pass to later owners, so a later owner of a Tarneit home can rely on them within that period.

Will you meet the builder's expert and attend the hearing?

Yes, when VCAT directs it. Experts can be ordered to meet in a conclave, narrow their differences in good faith and file a joint report of what is agreed, what is not and why, sometimes called a Scott Schedule. At a more complex hearing the report is usually taken as read, and the tribunal may hear the experts together as a panel.

When does the report need to be ready?

By the date in VCAT's orders. If no date is set, PNVCAT2 requires the report to be filed and served at least 10 business days before the mediation, compulsory conference or hearing where it will be relied on. A late report can be refused, so give us the tribunal dates when you book.

Who prepares the report?

An experienced building inspector who inspects the home, reviews the documents, states their qualifications and registration, and signs the declaration the practice note requires. The report states their qualifications and any relationship with you, as VCAT requires.

Do you prepare reports outside Tarneit, and how is the fee set?

Yes, across Wyndham and nearby, including Truganina, Hoppers Crossing, Werribee, Wyndham Vale, Point Cook, Williams Landing, Mount Cottrell and Manor Lakes. The fee depends on the number of items, the size of the home and the documents to review. We quote it once we have seen the contract and your defect list.
